Conditions of participation


§ 1 Competition
  1. (1) The companies Otto Weitzmann AG and Weitzmann Prime GmbH (in each case based: Heinrich-Hertz-Str. 1, 86179 Augsburg, Germany) – hereinafter together called „organizer“ – are doing a competition named „Luxury watches“ within the timeframe 1st of September 2016 until the 30th of June 2017 (hereinafter called „timeframe“).The organizer provides the prizes for this competition and is solely responsible for fulfiling any claim regarding these prizes.
  2. (2) Taking part in the competition is free of costs and also independent from buying products or making use of any paid or unpaid performance.
  3. (3) Any person that complies with the conditions of the competition can enter the competition. By entering the competition the participant accepts the following regulations.
§ 2 Participants
  1. (1) Any natural person that is at least 18 years old is entitled to participate in this competition.
  2. (2) The given personal details in the registration form are complete and correct.
§ 3 Exclusion from the competition
  1. (1) Employees of the obove (§ 1 I) named companies and also related subsidiary companies as well as relatives of these employees are excluded from taking part in the competition.
  2. (2) In case of violating these Conditions of participation the organizer reserves the right to exclude persons doing so – especially in case of a multiple participation and false or incomplete given personal details.
  3. (3) Persons that use unauthorised aids or try to get advantage by any other way of manipulation also will be excluded. This includes taking part via competition associations as well as automated services. In these cases the organizer also has the right – where appropriate – to determine and reclaiming prizes.
§ 4 Implementation and execution
  1. (1) The competition ist exclusively run by the organizer. The organizer is responible for the selection of the prizes.
  2. (2) Requirements for taking part in the competition:
    • Filling in and sending the provided data form; afterwards you will receive an email confirmation for your registration.
    • Confirm that you want to take part in the competition by clicking the appropriate link in this automatic email confirmation. Hereby you will take part in the competition.
  3. (3) The first prize among all female participants is the luxury watch „REIL MILANO MANTA 1970 DIAMOND CHRONO“ with 144 genuine Diamonds and a swiss Quality-movement – regular price EUR 2.521,-.
  4. The first prize among all male participants is the exclusive watch „WEITZMANN MASTERPIECE EDITION MODEL SCARPA“ with a swiss ETA-7750 movement – regular price EUR 2.890,-.
  5. Further more the following prices are being raffled among the rest of the female participants:
    Second prize: „BREIL MILANO“ ladies‘ watch – regular price EUR 540,-,
    Third prize: „BELLA JOYA“ ladies‘ watch „PARIS“ – regular price EUR 169,-.
  6. The following prices are being raffled among the rest of the male participants:
    Second prize: „BREIL MILANO MANTA 1970“ men‘s watch – regular price EUR 395,-,
    Third prize: diver's watch „OW WEITZMANN BODENSEE“ – regular price EUR 289,-.
  7. (4) Participation deadline is the 30th of June 2017 at 12 o’clock (pm). Relevant for being in time is the time we receive your confirmation for taking part in the competition by clicking the appropriate link in our automatic email confirmation on our server. In calendar week 27/2017 the lottery drawing will be carried out. For all prizes the procedure of drawing lots decides among all female participants on the one side and all male participants on the other side.
  8. (5) All winners will be informed by email not later than 2017.15.07 („winner notification“). By taking part in this competition every participant – until revoked – agrees in transmitting his personal data to the organizer and also saving and processing this data by the organizer in purpose of accomplishing and executing this competition. Further more every participant agrees right now that the organizer is allowed to publish his/her name on web pages or online portals of the organizer in case of winning a prize.
  9. (6) All prizes will be send to the winner’s address by postal service. Therefore the winner has to provide the organizer with his address by email within 10 days after the winner notification has been sent. Otherwise the prize will be forfeited and can not be claimed any further.
  10. (7) The sending of a prize is only possible one time. All prizes are send at receiver's risk The risk of accidental loss of the shipment is transferred to the winner at the time of handing over the shipment to the carrier. In case that a shipment fails because of reasons the organizer is not blamable for the prize will be forfeited. Any claim against the organizer is excluded in this case.
  11. (8) Cash payment for prizes or a conversion are excluded. Profit entitlements can not be transferred to a third person.
  12. (9) In case that it is not possible to hand over a prize or it is only possible under unreasonable circumstances, the winners will receive a substitute prize of equal value.
  13. (10) The winner is responsible for a taxation of the prize if necessary.
  14. (11) Complaints have to be addressed to the organizer in written form within 14 days after getting known the reason for the complaint. Complaints by telephone can’t be processed as well as late complaints.
§ 5 Early termination of the competition
    The organizer reserves the right to terminate this competition without prior notice at any time. The organizer will make use of this right especially when a proper execution of the competition is no longer guaranteed because of technical or legal reasons. In this context especially viruses as well as manipulations or defects of hardware and/or software are examples for technical reasons. If the termination is caused by a behavior of a participant the organizer has the right to claim his damage from this participant.
§ 6 Data protection
  1. (1) The organizer commits himself to strictly follow the rules for data protection and media law. Especially all given datas will be treated in strict confidence.
  2. (2) By taking part in this competition every participant – until revoked – agrees in transmitting his personal data to the organizer and also saving and processing this data by the organizer in purpose of accomplishing and executing this competition.
§ 7 Liability
  1. (1) By handing out the prize the organizer will be released from any obligations in regard to the prize. There’s no liability for material or legal defects.
  2. (2) The announcement of the winners shall be without guarantee.
  3. (3) The organizer is not liable for damages unless these damages are caused by intention or gross negligence of the organizer (and his responsible body, employees or vicarious agents). This shall apply to damages of all types, particularly damages which can be caused by errors, delays or disruptions in the transmission of data, breakdowns of the technical equipment and service, incorrect content, loss or deletion of data, viruses or in some other way when taking part in competitions.
§ 8 Final clauses
  1. (1) The law of Germany shall apply to these conditions of participation and the entire legal relationships between the organizer and the participants.
  2. (2) Should any provision of these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions of the contract.
§ 9 Legal process
    The legal process is excluded.
